Agreement to Terms
By accessing or using Taviera ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Eligibility
You must be at least 13 years old to use Taviera. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the App.
Account Registration
To access certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
User Content
You retain ownership of the content you upload to Taviera ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display your content in connection with operating and promoting the App.
You represent and warrant that:
- You own or have the necessary rights to the User Content you post
- Your User Content does not violate any third-party rights
- Your User Content complies with these Terms and applicable laws
Prohibited Conduct
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload content that infringes on intellectual property rights, privacy rights, or other rights of third parties
- Engage in spam, phishing, or other fraudulent activities
- Attempt to gain unauthorized access to the App or other users' accounts
- Use automated systems (bots, scrapers) to access the App without permission
- Interfere with or disrupt the App's functionality or servers
- Post sexually explicit or pornographic content
- Promote violence, discrimination, or hate speech
- Violate any applicable laws or regulations
Content Moderation
We reserve the right, but are not obligated, to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We may take action including warning, suspending, or terminating accounts that violate these Terms.
Intellectual Property
The App and its original content (excluding User Content), features, and functionality are owned by Taviera and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Third-Party Services
The App may contain links to third-party websites or services that are not owned or controlled by Taviera. We are not responsible for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of third-party services.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAVIERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.
Indemnification
You agree to indemnify, defend, and hold harmless Taviera and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.
Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Taviera operates, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
